The present research studies the SAR operation; the collaboration/non-collaboration between State-Coast Guard and civil society and the respect of the ”right to rescue” (Art 2.1 EU Charter) are the main focus. Is the “right to have rights” still a value in the EU community? Which role does civil society play on the European political stage?

The “refugee crisis” put the EU member states into crisis when the migrant flows transformed public opinion into an anti migrant group. The situation of migrants was omnipresent in every newspaper and media newscast in order to attract audience; most of the time with an electoral purpose and elaborated through certain chosen words such as clandestine, illegal, etc. The wave of migration became an "unusual” phenomenon. The act of “seeking to become” within the globalised world transformed the regular character of migration into an ”occasion” for the “selected ones”. Despite of the regular character wanted by the international community, thousands of people crossed the Mediterranean trying to escape war, political persecution or searching for a better life.
